H1B Visa Lawyer Blog Has Just Posted the Following:
Each month, annual preferences and foreign state limitations are subdivided by the Visa Office into monthly portions based on the applicants reported at consular posts and CIS Offices. If there is a sufficient amount of visas in a category to supply the demand then that category is considered �current� but when the demand over-exceeds the allotted supply of visas the category is considered �oversubscribed.� This is when a visa cut-off date is established, the cut-off date is the �priority date of the first documentarily qualified applicant would could not be accommodated for a visa number.�

Hi,
I came to US on L1 Visa and later applied for COS to H1 last year. I work for consulting company. My client wants me to travel to Nigeria for 3-4 weeks for project implementation. I would like to if I can get my H1 Visa stamping there. Will there be any issues in getting the stamping and should I need to do any legal preparation for the same ?
I would like to hear advice from seniors and anyone who has faced similar situation.

Please help!
My AP is pending and my H1 visa on passport has expired like 3 months back. I am on valid H1 status which is good for another 3 years till 2010. I have scheduled H1 stamping renewal interview in India. Can there be any problems in H1 visa stamping as my AP application (I131)is still pending?

I hope your h1b stamping worked out well. if I would have read this post earlier then I would have warned you about 221(g) adminitrative processing which is a possibility for delay. I am in the boat for over 75 days and did not leave with AP approval. Got it after my interview and my lawyer advised me against using it.

On the other hand..god forbid you got 221g...but if you did then did you used your approved AP (if it got approved while you were out of the US) to go back to the US? What was your lawyers opinion on this?

yes it can happen....
my case: we both filed under premium for our 7th year extension last year and hubby was processed in 5 days, but my H4 took 5 months together with RFE. RFE was stupid enough, they asked to see a copy of already approved H1 7th year.
My advice, wait and see what happens....
Sometimes they pick up H4 a week or so after h1. Good luck.

I have these below queries on Green card processing
My Green card processing background
My labor and I140 are approved and have priority date of May 2006 under EB3 category.
The reason for these questions is that I am planning to change the company that I am working with.
Questions.
1. Can I port the priority date (March 2006) when applying for new green card with new employer.
2. If possible to port the priority date can I apply under EB2 category assuming all other criteria satisfy for EB2 category and use the same (May 2006) priority date.

i think majority of the Eb2 filings are under audit..
i ran my first ad..this sunday..and my lawyer didnt say a thing abt change in perm process.. but he did mention that Eb2 are being scrutinized more.

I have to agree that the back ground is a bit distracting, but the petal is a very cool shot. If this were my shot I would try a few things in Photoshop to change it up. Like maybe make the background black and try black and white? Something like that may add something to it. Just a thought. Don't give up on it there's something there it just has to be found-:)!!

Read above post, It is a number starting with A and looks like A099 XXX XXX usually found on I140. I dont think this number is alloted anytime before an immigrant petition is filed.
MRSR question for you. My sons/wifes I94# is different based on actual I94 (last entry) and H4 approval notices (done after entry). Mine remained same. Dilemma which number should i use in their forms.

I and my my spose applied for AP during April 1st week, both of our AP got rejected because of incorrect fee even though we paid correct fee (305$ each applicant), has any one been in this state, please share your experiences.
I have re-sent the application mentioning Advance parole does not require biometrics so additional 85$ fee is not required.
When I called USCIS they mentioned it might have been rejected in error, please share your experiences.

Hi,
I looked at the list of civil surgeons that approved by USCIS. I called some of them and everyone told me differently in pricing. The basic I693 test would cost around $$220, and if i need vaccines, It would be an addition cost. Like some said the MMR vaccine would cost $120, the other said $50
Lot of them said the cost for chicken pox vaccins is around $120 ( I dont have insurance). My parent is not really sure if I ever have chicken pox or not so incase I need one, DO you know where to get those shots cheaper? Thank you for your time!

I am a derived applicant in my green card process and recently I converted to EAD status from H1B.
My sister is US citizen. I would like to know if I am eligible to file another set of green card application thru family based option that is available. I know its a long queue.
I want to know if I am eligible for this process.
If I am eligible to file, am I eligible to file EAD thru that application as well.

Two questions for the experts...
I am on J1 visa and have received a home residency requirement waiver. Do the experts here know if I can apply for a J1 visa extension (after receiving the waiver)? I read somewhere that it may not be possible to do so.
Also, are there are any foreign travel restriction on a J-1 visa?

It is difficult to predict the timeline.
The house members are not happy with the Senate bill.
I have read that the conference committee may meet next monday ( all hearsay).
We can only pray and hope for the best.
how long is the conference comittee process? and after that should the bill go thru house also? or will it go to president's desk??

I believe that would fall under "contemporary art".....you know, something a very wealthy person would read waaaay too much into and spend an ungodly amount of money for. ;)
