Hi All,
My Case:
I am planning to travel to India from 11-March till 27-March and my current petition(VISA) ends on 5-April. My company already filled for the extension process (on 30-Jan).
Three possible scenarios
1. If I get the extension approval before leaving to India, do I have to set up a stamping slot at the US consulate in India or can I just carry the new petition and while entering back in US just show that to the immigration officer.
2. If the approval comes on 26-March, what should I do, can I still travel to US without the new stamping.
3. If I dont get the approval till 27-March, can I travel to US with my old petition without any problem?

Hello Guys,
First and foremost my sympathies on being a part of MI where almost everything is going the wrong way work situation, housing market and weather its been raining for almost 2 days now :), for fellow members there is another hassle of worrying about your immigration status.
Things are bleak no doubt about that but we can make a difference no I am not trying to act or sound like The President of United States here, just trying to make a point. Hey given the present situation we can either lie down and take what the government has in store for us (which is erratic movements of PD�s through the visa bulletin which are most probably by the shots taken by the DOL just before the release of the visa bulletin) or take up the fight and try to make our voice heard.
Hence to restart the chapter I would like to see if any of you are interested in a face to face meet to exchange stories and to brainstorm ideas to tackle the situation that we face currently.
Ideas and suggestions welcome, lets make the change that we were promised last year.

I am about to switch to a new employer using AC21 and would work on EAD. I still have more than 2 years on my current H1B (i.e. I'm on 4th year right now).
Can I re-use my remaining H1B in case I need to in future? Because in case my I-485 gets a denial (which shouldn't be the case) I would be out of status!

i thought there was something extra... that you have to be in 485 pending for atleast one year .. if you are a july filer 1 year gona be completed in the begining of july ...

Hi,
I am lost trying to find information on this.
Here's the situation for adding my wife to my I-485 application (we are from India). We DO have her 100% correct birth certificate we got issued last month.
However, since the issue date on it is April 2011, our lawyer insists that we need affidavits from her parents as well (perhaps to avoid RFEs). Further the lawyer insists that the Foreign Affairs Manual for India states that these be sworn in front of a first class magistrate of India.
When her parents went to the local court and request the first class magistrate, the court officer is demanding that we have a sealed copy of the requesting authority (USCIS) that clearly states that a first class magistrate's signature is required!
Questions:
(i) Is the affidavit supposed to be sworn in front of first class magistrate? Even if we have a corrected birth certificate?? Or can it be signed by an 'Executive Magistrate' or maybe even just notarized??
(ii) If yes, did someone else face a similar issue?
(iii) If yes, is there a USCIS document I could send to satisfy their demand?
I did try to find a USCIS document but all it states is that ... IF the birth certificate is unavailable ... then "sworn affidavits" need to accompany non-availability certificate from a competent local government authority.
Please advise :(

Working with an employer since 2001, EB 3 PD Dec 2003, EAD in 2007, Still on H1b until Nov 10. Though have two masters (both rec'd prior to 2003) i had filed under EB 3 (no one to balim it was just me...was not proactive enough/not enough guidence from the lawyer)
With the same employer, i have rec'd EB 2 approval, want to file I 140 and port EB 3 PD.
Need help/input with folloiwng from the gurus:
1) in EB 3 application the title is "Construction Engineer" with 4 lines of scope of work clarification with bachelors degree in civil engg. and no experience requirement. In EB 2 application, we have used same title "Construction Engineer" with 4 lines of scope of work, we had left 2 lines common (as earlier in EB3 application) and 2 new lines (related to environmental engg. since i have two env. engg. masters with BE in civil engg.)......this ad asked for MS in env. engg. or similar degree with no experience requirement.
Question: EB 2 Labor is approved, i am not sure what they check with i 140 application but does above sound reasonable (not that anything can be changed...but asking for an opinion here).
2) With premium processing, how long it takes to get I140 approved?

Mine got approved in about 2 months time. My labor certificate reached the lawyer who passed it on to my employer.
I did a big mistake of not asking for a copy and again when I received it while filing I140 - did not make a copy again.
Please save a copy for yourself - it helps a lot while switching jobs during AC21.

Hi there,
One of my friend who just finished his masters and in process of getting his OPT in hand, also he is planning to file his H1B visa in 2010.
While his status in OPT he got an oppertunity to own a corporation, my questions to you all as follows.....
1. Can he own a coroporation while his status on OPT? I know one can own a corporation if his/her status is on H1B.
2. If he own corporation with his current status (OPT) and if he files his H1B in year 2010; what issue might he face?
3. Are there any legal obligations to own a corporation while his status on OPT? Or does he require to take any extra measures / precautions to own this coporation?
Note: He just wants own this company and not plan to do anything much to it until he settles down and he wanted utilize this oppertunity.

Congressman Sensenbrenner has long and loudly proclaimed that he is not against all immigration, just the illegal variety. Fine. Let�s take him at his word. He is, after all, the architect of the new E-3 visa that enables 10,500 Australians to get around the H-1B cap. Congressman Sensenbrenner has his enforcement-only bill now so he should be prepared to support us when we seek to attach Section 8001 to broadly bipartisan legislation in the upcoming session of Congress. If Congressman Sensenbrenner means what he says, and he usually does, this might be a golden opportunity to bring Section 8001 back to life.

AR-11 form you send to different address . It is not part of I-485.
It is less likely that they compare your addresses with AR-11 address audit logs.
I think you should not worry too much about it.
Though you need to send AR-11 with in 10 days of your move to new address , I guess you can still send AR-11 form ,as AR-11 form does not ask from which date you moved to the new address. Check with your lawyer also
