What are the timelines for I-539 Change of Status for H1 to H4?
Is premium processing option available for the this change of status?
Friend worked till last week of pregnancy (clean H1 history before). Her 12 weeks of maternity leave is ending soon and looks like the family needs to pay attention to child's condition and she has no choice but to become a full-time mom (another full-time job in itself though). She was in status during her maternity leave (some part of which was covered by STD insurance, remaining unpaid leave totaling 12 weeks under FMLA). She needs to change her status from H1 to H4.
- File for H1-H4 ASAP with in the unpaid leave window
- No premium processing available for H4

It's really unfortunate, but what's in that cartoon is the truth. The humor is for people who don't have to go through that flow-chart or the people who get out quick.
for people who are in that loop for 13 years, it's the tragedy of life.
Nevertheless, I vote for that cartoon. I think it can depict the truth, pains of immigrants through a medium that a layman can understand.

You did well not to center the horizon (a common problem), though if you're going to show that much sky, I'd like to see something a little more interesting up there. ;)

My Daughter is traveling on AP, she does not have an EAD.
Her H4 is valid until 8/1/2010, and AP is valid until 10/10/2008. She is coming back here on 8/12/2008
Can anyone please help me with this question?

I had a lot of emotional and financial distress upon my graduation and I didn't get to apply for OPT. What do I do?
I mean I know I need to go speak with the dept that handles intl students in my school?

Or I have to pay seperate $1000 for spouse's 485?
No, it does not include the spouse's application. The fee schedule will give you a good idea of what the fees are for each category.

I am going to complete my 6th year on H-1b, this year end. My I 140 is cleared and I am going to file for 3 years extension. In the beginning of this year, for 3 months pay stubs are not run, due to some personal reasons. Will this affect my renewal of H1. We need to submit 3 pay stubs, before applying for extension. There will be a shortfall of YTD, when compared to actual. Please share your thoughts, who have clear understanding on these. thanking you.

I am working for one of the largest companies as mechanical engineer. I am shifting from Mechanical engineer to program manager job within the same company. The job requirement is
BS + 2-5 years of experience
I have
Bachelors 4 Years
Masters in USA
Research Assistant 1 year 8 months
Teaching Assistant 11 months
Experience as a Mechanical engineer 3 years 8 months
Am I eligible for eb2 category? Help greatly appreciated.

2. The experience can not be counted from the current employment if the GC sponsor also the same until the new job is Significantly different than the current job.
3. If you have degree in Mechanical Eng. I am not sure how you can count that for program manager. Prepare yourself if USCIS asks the same question.

I just wanted to check that how many years of experience required for EB2 for a bachelor degree holder. I heard earlier it was 5 years but now the uscis has changed or planning to change to 10 years. Please clarify this.

I posted this on my facebook. Just to spread the message. I think most people think immigrants steal their jobs, but the truth is sometimes we struggle to hire a local person and then a foreigner walks in with the skills we need, but we can't hire him. (this is not to say we have not had good quality local people for the job as well)

One of my friend is in the same situation and he has been told by his lawyer that he can get his part-time concurrent H1 Extn for 3 years based on fulltime concurrent H1 approved I-140.
He is going to apply the same soon.

It looks like the rumors are no more circulating of people being deported.
There are no posts on the forum about it. So either there are no deportations now or people have realized that they were only rumors.
