I said that as the LCA results will be out in 9 months or less according to the current scenario which gives me time for filing the I-140 before July 2011. Shouldn't I be having a 3 yr extension then? The Talent services Manager at my office said so..

Since you have started your GC process and shown your intent to immigrate your F1 will be denied.
H1 is a dual intent visa ( you enter as non immigrant but U can immigrate on it) and hence application of GC has no implication on it.
Again I am not a lawyer so consult one.

AR-11 form you send to different address . It is not part of I-485.
It is less likely that they compare your addresses with AR-11 address audit logs.
I think you should not worry too much about it.
Though you need to send AR-11 with in 10 days of your move to new address , I guess you can still send AR-11 form ,as AR-11 form does not ask from which date you moved to the new address. Check with your lawyer also

Priority Date comes first, and then country limit. Country limit is not respected at the last quarter of each Visa Year (July to Sep).
If you're on EB2, then you're on for approval as soon as everything clears (security check, etc.). If you're on EB3, wait for a while dear. It will not come soon.

I-140 approved. I haven't applied for I-140 yet.
I am looking to move to different position with similar job responsibilities within my company.
I spoke to company's internal legal dept - and as per them they would require -
a) My current job responsibilty as filed on GC app
b) New Job responsibilties from new manager
c) A note from new manager stating that new job responsibilities are similar to current one.
With this documentation, I could use my existing I-140 & don't have to file for H1-B, labor & I-140 again.
Do I need to be concerned for anything else?

Thanks for your reply. In this specific skills or requirements, we also listed several tools, I let my former employer listed them in their experience letter. Other than that, I really don't how to proof them.
on 2nd req, my opinion would be to submit following related to ur skills.
- certifications earned from industry recognised bodies like PMP or OCP etc.
- any inhouse training recd certificates
- any vendor recd training certificates

So before I-485 becomes current, as long as I-140 gets approved, then we are okay to lose current job, either laid off or change job? I think I-140 approval doesn't take long, right? It's just I-485 takes forever?
I'm quite new to this process. My employer just filed Labor Certificate last week. I'm also a little worried if my employer goes bankruptcy some day.

No the process must be completely restarted if you loose your job after I-140 approval.The only thing you get is the priority date.If your I-485 is already applied and it is pending for 180 days then there is no issue and you are safe.

I came in US with my family when I was 15-16, back then we were on L2, then as time passed by we switched to H4. Then I turned 21 so I had to go on Student Visa (F1). Still living in US legally.
Now my question is I've been staying in US over 10 years now, legally. I dont know if its rumor or not, but someone told me, that you can apply for Green Card if you lived in US over 10 years legally, is that true?
Going through all that H1B process sounds really hectic. Also all my family members, friends and relatives are here, I don't know anyone back in my birthplace. any suggestions or tips, would help a bit.

My parents are planning to go for a visa interview. What is difference between me inviting them to visit me versus they applying as tourists. I understand that if they apply as tourists they need to provide documents showing that they can support themselves.
Will coming as a tourist diminish the possibility of getting 10 year multiple entry visa. Any thoughts on this issue is much appreciated.

A background on my case. I have a valid H-1, stamped on my passport. Also, I have my GC in process for 4.5 yrs. My husband was on pending I-485 & working on EAD. In may 2010, my pending I-140 was denied and then appealed. And following that, both mine & my husband's I-485 was denied after 2 months. Our lawyer did file MTR within 30 days of I-485 denial and its still pending:
Questions:
1) Can my husband apply for H-4 by being within USA or he has to leave the country?
2) Also, since he is not on any non-immigrant status, does the accrual of 180 days of illegal stay apply to him?
3) If it does apply, what are the chances of him getting the H-4 approved if he applies from Canada or home country?
4) & If he leaves the country, is he abondoning the pending MTR of I-485 which would lead him be out of the GC process completely?
Any expert input & feedback on my queries will help me to figure out my scenario. I have consulted couple of lawyers on my case, but all of us has mixed feedback which is making it very tough to get the right answer & make the right decision. I am in complete messy situation right now.
Also, if somebody gone thru or going through the similar situation pls. let me know what was the result on your case. Ur help is highly appreciated

The parent company bought another company B recently and have asked me move to B for business reasons in a similar role as with company A. Could I file a new GC with B and use my 10+ years experience with A to file for under EB2. I am currently under EB3-I category
