Myself(Husband) & mywife both came on H1B from same employer.
My son got H4 visa through my wife H1B visa.
I (Husband) applied for green card and got EAD for myself & mywife , got Advance parole for myself, mywife & myson and are in 485 pending AOS status,
My Wife is taking permanent job with EAD (EAD is through my Greencard process)
If employer cancels my wife H1B she will come to EAD status.
I am not sure what will be the status of my son who is currently on H4 visa through my wife H1B visa.

Do I need to apply for H4 visa for my son or will my son be ok on pending AOS status ?
His status is AOS. Unless a decision is made on your GC he needs no other visa or documentation to be in USA. If your GC application gets denied (Should not happen ever) then you lose AOS and you will have to talk to an attorney to see how long you can be in US - for the sake of filing an MTR etc.
Once a person files for 485 and application is pending a decision they can be in US without a VISA. If you travel outta US and needs re-entry that could be done useing AP. Hope this helps........

Iam on L2 and working on my EAD which is expiring on april 29 th 2011.
I have applied for H1 in the 2010 quota but due to my employers mistake i got a rejection on that.
we are trying to reappeal to USCIS but iam not sure if its going to work.
Suppose i have a project and apply again for 2011 quota , can i still continue working even if my EAD expires.
They say that we actually move to H1 on October , so if i apply before end of April through premium processing and get an approval notice before October can i continue working or start work right away or do i have to wait till October.
Is there a possibility to start working immediately as soon as my H1 gets approved or do we have to wait until October in any case.

There is no issue if your wife is the derivative applicant and gets her EAD through you. You can also start but it is more complicated since your business has to be doing excatly the same thing as your labor application. Also, i think you should get lawyers advice if you are starting it. There is no complication for your wife to start a business.

The business started by you need not be the same as in your labor application as long as you maintain your job with current employer or you switch to a similar job. For example, you can start a company for renting real estate without any problem as long as you can show that your job as stated in the LCA still exists ow will exist when the GC is approved.

My birth was regiestered under totally different first name, also DOB is off by 9 days (10th June instead of 1st June). Since the birth is registered they are not issueing non-availability cert. . What to do?
I have both parents affidavits, school leaving cert, 10th class cert, PAN card showing date/place same as that in passport. Filing a civil case in India is the option but it could take more than a year. since my PD is Sep04, my 485 could be processed within months.

AFAIK, everybody needs to fill out form I-9.

I am on h1b visa in my 6th year. My previous employer had applied for my GC under EB3. My I-140 was approved from old employer with the PD of october 2007.Now, my new employer is going to file the GC under EB2 but the lawyer is not sure if the I-140 would be approved (since its EB2). My question is:
If the new I-140 gets denied due to any reason, will my old I-140 still be valid (under EB3). The old I-140 has not been revoked or withdrawn. My new employer has applied for my h1b extension (beyond 6th year) on the basis of my previous approved I-140. pls do reply. thanks.

Looks like the pundits are saying that the House, and possily Senate, will fall into Democrat hands beginning January.
Here is what Robert Novak says:
The conventional wisdom about the 2006 elections among both Republicans and Democrats now is that the Democrats will take control of the House and could also win the Senate. One House Republican committee chairman, who publicly exudes optimism, privately predicts -- and has predicted for six months -- a loss of 30 House seats.

If that's a wisdom, no wonder Democrats are in no mood to compromise on CIR. That also explains the chilly reception to Hutshison-Pence. When the democrats have the house they'll craft a new immigraton package and compromise with the perhaps even more democrat-leaning senate. So 2007 is going to be the year of CIR. If the republicans are smart, they're going to try to get best immigration deal possible in the lameduck session before the 110th Congress starts in January. But the democrats may block it altogether. In that case the retrictionists are going to be sorry they didn't take the best deal when it was available (which look like now).

Not sure about what can you do by yourself � in this situation would contact some immigration attorney.
More than likely you need to file Motion to reopen (and gain some time)� otherwise you would end up in a one way street �-however not sure about who will need to file (you or your father)? Also not sure about what would be the basis for filing such a case .
Deportation � Since (I assume) you are in the US legally since 98 even if they start the deportation process probably you can file for some relief (I guess if you are here for 7 or 10 years -legally! -then in a case like that there could be some way to avoid deportation, but this would not be automatic).
I would consult with a immigration lawyer....

My Husband�s priority date is Oct 2003 (EB3). My Employer is willing to start for GC in EB2. Can We use my husband�s EB3 Oct 2003 priority date ?

You will not jeopardize your I-485 as long as job with company C is in same or similar occupation. Whether USCIS will grant an H-1 3 year extension based on a withdrawn/revoked I-140 is not certain. I outlined the reasons for this uncertainty in my response on the thread entitled "Facing Layoff---6 months left..."

I don't know about any of those lenses from personal experience, but for what it's worth, Bj�rn R�rslett rates the f/4 version at 2.5 out of 5 (on a D1x, which is similar in resolution to the D70), and doesn't have much praise for its image quality. I'd guess that the f/4-5.6 versions, being newer designs, should be better.
